1. Agreement to Terms

These Terms & Conditions govern your access to and use of MyAbhyaash, Nepal's leading entrance exam preparation platform for CEE and IOE. By using MyAbhyaash, you agree to these terms. The Service is operated by Nexum Technologies Pvt. Ltd. (Government of Nepal Registration No. 393523/82/83).

Accounts are created exclusively by MyAbhyaash administrators and provided to college administrators. Students do not self-register.

2. Acceptance of Terms

By accessing or using MyAbhyaash (the "Service"), you agree to be bound by these Terms & Conditions ("Terms"). If you do not agree to these Terms, you may not use the Service.

3. Account Creation & User Types

How Accounts Are Created

MyAbhyaash does not allow self-registration. All student accounts are created by MyAbhyaash administrators following a partnership agreement between your college and MyAbhyaash. Student credentials (username and password) are generated by MyAbhyaash and provided to your college administrator for distribution to students.

Student Responsibilities

As a student using MyAbhyaash, you agree to:

• Use the Service only for legitimate entrance exam preparation
• Keep your login credentials secure and not share them with others
• Not attempt to reverse-engineer, hack, or exploit the platform
• Respect the intellectual property of all questions and content
• Not engage in cheating, credential sharing, or impersonation
• Comply with all applicable laws and your college's policies

College Administrator Responsibilities

As a college administrator using MyAbhyaash, you agree to:

• Distribute student credentials securely and only to authorized students
• Inform students how the platform is used for monitoring and analytics
• Obtain necessary consent from students (or guardians for minors)
• Maintain secure access to your administrator dashboard
• Comply with the annual subscription agreement and pricing terms
• Comply with all applicable laws regarding student data
• Manage credentials responsibly and revoke access when students leave the institution

4. Intellectual Property

All content on MyAbhyaash—including questions, explanations, images, graphics, and software—is owned by Nexum Technologies Pvt. Ltd. or licensed to us. You may not reproduce, distribute, modify, or transmit any content without explicit written permission.

5. Subscription & Pricing

• Billing Cycle: Annual subscription per student or per institution
• Payment Terms: Payment due upon invoice issuance or per signed agreement
• Renewal: Subscriptions renew automatically unless cancelled 30 days before expiry
• Refunds: No refunds are issued for partial years. Cancellation takes effect at subscription end date

6. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, NEXUM TECHNOLOGIES SHALL NOT BE LIABLE FOR:

• Indirect, incidental, special, consequential, or punitive damages
• Loss of data, revenue, or business opportunities
• Exam results or entrance exam outcomes
• Service interruptions, downtime, or data loss

Our total liability shall not exceed the amount paid by you in the 12 months preceding the claim.

7. Warranties Disclaimer

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." WE MAKE NO WARRANTY THAT:

• The Service will meet your expectations or requirements
• The Service will be uninterrupted, error-free, or secure
• Using the Service will improve exam results or entrance outcomes

8. Prohibited Activities

You agree not to:

• Hack, exploit, or attempt unauthorized access to the platform
• Share credentials or accounts with unauthorized users
• Engage in fraudulent activities or impersonation
• Post abusive, threatening, or obscene content
• Attempt to disrupt the Service or overload servers
• Engage in automated scraping or data harvesting

9. Suspension & Termination

We reserve the right to suspend or terminate your access immediately if you violate these Terms or engage in prohibited activities. Upon termination, your right to use the Service ceases. We may delete your data per our Data Retention Policy.

10. Governing Law

These Terms are governed by and construed in accordance with the laws of Nepal. Any disputes shall be resolved in the courts of Kathmandu, Nepal.
